TERMS AND CONDITIONS

DAMAGED ITEMS

Please read the following Terms & Conditions carefully.  By placing an order with us you are deemed to have read, understood and accepted these terms and conditions.

1. Definitions

1.1 ‘The Company’ means Issy & Olly’s Pooch Emporium

​

1.2 ‘Customer’ means any Company or Individual who uses this website to place an Order with the Company

​

1.3 ‘Goods’, ‘Products’ means any items offered for sale by the Company.

​

2. Contract

2.1      Prior to placing products in the Shopping Bag, new Customers will be required to complete a Registration form, and existing customers will be required to Log In.  The Company requires this information to fulfil any contractual obligations.

​

2.2      Prior to placing an order, the Customer should ensure that their Dog does not suffer from any allergies, or have any special dietary requirements, that would make our products unsuitable.  The Company cannot accept any liability for the consequences of any allergic reaction to their products.

​

2.3      Once the Customer has completed the checkout procedure, and payment has been made then an Order will be deemed to have been placed.  An Order Confirmation will be sent.

​

2.4      The Company reserves the right to refuse any Order and will not be obliged to provide a reason for doing so.  Any payment made by the Customer will be refunded in full and the Contract deemed to be terminated.  The Company shall not be liable for any costs incurred by the Customer as a result of this termination.

2.5      Under the United Kingdom’s ‘Distance Selling Regulations’, ordinarily the Customer has the right to cancel a Contract for the purchase of any item within seven working days of delivery.  However, this does not apply to any items made specifically for the Customer.  As the Company’s products are “handmade to order”, the Company reserves the right to accept a cancellation from the Customer only in exceptional circumstances.

2.6      In the event of a cancellation by the Customer, a fee of 10% of the Order value will be charged by The Company to cover administrative expenses.

​

2.7      Should the Company be unable to supply any of the products ordered for any reason, the Customer will be contacted and offered an explanation and the opportunity to cancel the Order.  Should the Customer decide to cancel the Order then any payment made will be refunded in full.

​

3. Price

3.1      The Company’s prices may be subject to change without notice.

​

4. Payment

4.1      The Company’s online payment system is administered by Square with most major Credit and Debit cards being accepted.  The Company cannot accept any Orders for which payment has not been received in full.

 

5. Delivery

5.1      Issy & Olly’s Pooch Emporium will process your order within two working days of receipt. A shipment usually takes 2 - 3 business days for arrival. Door to door delivery is £1.50 within a 3 mile radius of IOPE's postal address, and postage/shipment is £3.95 outside of this radius, but free for orders over £30.00

Delivery days exclude weekends and Bank Holidays. 

​

5.2      Deliveries will be made to the address and postcode provided by the Customer and the Company cannot accept liability for a late or failed delivery due to an incorrect address.

​

5.3      Once the Customers order is despatched, a Despatch Confirmation will be sent.  The Company cannot accept liability for either the late delivery, or non-delivery of goods as these are deemed to be wholly beyond the Company’s control.

 

6. Warranty

6.1      The Company warrants that all goods will be free from defects at the time of despatch.

6.2      Due to the handmade nature of the Company’s products some variation in size, design, and colours should be expected.  The surface of some biscuits may show a dusting of flour on them. This due to the rolling out process and in no way affects the integrity of the product.  These variations will not be classed as a defect.

​

6.3      If the Customer is unhappy with the quality of the products received then the Company will refund the cost of the goods purchased on the following basis:

 

6.3.1   That the Customer notifies the Company of any defects within 24 hours of delivery;

​

6.3.2   That the Company be given a reasonable opportunity to view the products in question (in many cases photographic evidence from the Customer may suffice);

 

6.3.3   That if the claim is accepted, the Company will only refund the cost of the goods purchased.  The cost of Delivery will not be refunded.

​

6.4      Should the Customers order be damaged in transit, then the Company will refund the cost of the Order in full, on the following basis;

​

6.4.1   That the Customer notifies the Company of any damage within 24 
hours of delivery;

​

6.4.2   That the Company be given a reasonable opportunity to view the products in question (in many cases photographic evidence from the Customer may suffice);

​

6.4.3   That the Customer retains both the damaged goods and the packaging (to assist the Company in pursuit of its compensation claim with Hermes) until informed by the Company that this is no longer required;

​

6.4.4   The Company will refund the cost of the Order in full once the claim has been accepted by mailing service provider.

​

6.5      Unless by prior agreement with the Company, goods should not be returned.  The Company will accept no liability for any costs incurred by Customer should they decide to return goods purchased of their own volition.

7. Website Content

7.1      Every effort has been made to ensure that the images and information displayed on the Company’s website is accurate.  Due to the handmade nature of the Company’s products, images should be regarded as representational and do not form part of the Contract between the Company and the Customer.

​

7.2      The company reserves the right to make changes to the content of this website, including these Terms & Conditions, without prior notice.

​

7.3      The content of this website is protected by Copyright.  No part of this website may be produced in any from without prior permission, in writing, from the Company.

​

7.4      This website may contain links to external sites. However, the Company cannot be held responsible for the content of any website that is linked to the Company’s website.

​

8. This Agreement

8.1      The Company shall not be held liable for any loss or damage incurred by the Customer as a result of Force Majeure.  The Company shall notify the Customer as soon as possible should such an event occur.

​

8.2      Any dispute between the Company and the Customer resulting from these Terms & Conditions will be subject to the jurisdiction of the courts of England and Wales.
